Re: Citizenship Application Autumn/Winter/Spring- 2016/2017
This may not be so simple.
I am flabbergasted to receive a negative decision because decision said I do not satisfy the last 2 years of continuous residency for my case. Knowledgeble people PLEASE CONFIRM this and WHAT SHOULD I DO ???????????????
I have been in Finland from
a) Jul 2005 to Jun 2008 (B Type permit)
b) Jun 2008 to Jun 2012 (A type permit)
c) Jun 2012 to Jun 2013 (P type Permit)
d) *********** Jun 2013 to May 2015 (overseas) ---> Less than 2 years
e) Jun 2015 to Feb 2016 (Permanent)
f) ********** Mar 2016 to Aug 2016 ( overseas )----> less than 6 months
g) Sep 2016 to Nov 2016 (P type permit)
h) ********** Nov 2016 - Dec 2016 ( (overseas ) ---> Less than 1 month
i) Dec 2016 to PRESENT (P Type Permit)
So Last 2 years I have been overseas less than 7 months
Therefore, In MY OPINION, I am have accumulated total of 7 years -(b) + (c) + (e) + (g) + (i) WITH LAST 2 YEARS Continuous residence - (e, f, g, h, i)
The reason is as follows in the link:
http://www.migri.fi/finnish_citizenship ... de_finland
i.e. (from above link)
The following periods of absence will not interrupt your continuous period of residence:
absences that last a maximum of one month
a maximum of six periods of absence that last 1–2 months each
a maximum of two periods of absence that last 2–6 months each
If you are temporarily absent from Finland for over six months but no longer than one year, your continuous period of residence will not be interrupted. However, the period of absence is not counted as continuous residential time.
..............
.............
Accumulated period of residence
If your continuous period of residence is interrupted, your periods of residence in Finland will be taken into account as an accumulated period of residence. The accumulated period of residence may consist of several periods of residence in Finland. The required total period is a minimum of seven years. Of this time, you must have lived in Finland continuously for the past two years. If your period of residence is calculated as having been accumulated over several periods, the periods of absence over the last two years must not exceed eight months. The time you have spent in Finland with a temporary residence permit (B-permit) will not be included in the accumulated period of residence.
PLEASE SHARE WHAT I SHOULD DO???? APPEAL??? What path? What are my chances with appeal? Any suggestions who would be a good person to represent. Links??
(honestly life is so uncertain.... 2 years continuous wait is so uncertain if you have e.g. ailing parents etc. overseas.....dont want to get into the cycle of endless wait) Honestly I feel I had covered all known conditions to be given a positive decision.

Sad, but they don't care too much of your permit, look at https://verkkopalvelu.vrk.fi/Omat/Etusivu.aspx and if you don't see last 2 years marked in Finland there is nothing you can do.
Also looking at this accumulated residence period:
a) Jul 2005 to Jun 2008 (B Type permit)
b) Jun 2008 to Jun 2012 (A type permit)
c) Jun 2012 to Jun 2013 (P type Permit)
d) *********** Jun 2013 to May 2015 (overseas) ---> Less than 2 years
e) Jun 2015 to Feb 2016 (Permanent)
f) ********** Mar 2016 to Aug 2016 ( overseas )----> less than 6 months
g) Sep 2016 to Nov 2016 (P type permit)
h) ********** Nov 2016 - Dec 2016 ( (overseas ) ---> Less than 1 month
i) Dec 2016 to PRESENT (P Type Permit)
a) is not counted into that. Rough calculation 2017 - 2008 = 9 years - 2 years (d) - 7 months (f + h) is less than 7 years!
Also I think the last 2 years are interrupted. You can have absences from Finland in case of continuous residence period, nothing is mentioned about accumulated residence period.

Well as per the rules (not more than 6 months trip, less than 1 month trip) i.e. the (f+h) i.e. 7 months are NOT counted against the applicant.tavastia wrote:Sad, but they don't care too much of your permit, look at https://verkkopalvelu.vrk.fi/Omat/Etusivu.aspx and if you don't see last 2 years marked in Finland there is nothing you can do.

The last 2 years criteria also has some allowed time for overseas trips from the text I copy pasted from the link.

Check your own data in VRK, have you announced Maistratti that you lived abroad those last long trips? 6 months and 1 month?challengingtimes wrote:Well as per the rules (not more than 6 months trip, less than 1 month trip) i.e. the (f+h) i.e. 7 months are NOT counted against the applicant.tavastia wrote:Sad, but they don't care too much of your permit, look at https://verkkopalvelu.vrk.fi/Omat/Etusivu.aspx and if you don't see last 2 years marked in Finland there is nothing you can do.

Less than 1 month need not be announced, I declared it in my application voluntarily. For the less than 6 months I had conveyed to Maistraati.
Anyone know how long the Appeal process takes in these matters in the Finnish court. It seems that is the only way for this any change in the future of this negative decision.
Other is to again bide the time and apply again (Which might get disrupted again due to innumerable natural dependencies etc...)
Re: Citizenship Application Autumn/Winter/Spring- 2016/2017
When you change your address at Maistratti your residence period will be interrupted, you are not living in Finland for that period, is not a trip, so in my own opinion your last 2 years are interrupted.challengingtimes wrote: Less than 1 month need not be announced, I declared it in my application voluntarily. Appeal will cost you more (a lawyer can be even 400€/h) and take longer than applying again when you have 2 years not interrupted period.
Re: Citizenship Application Autumn/Winter/Spring- 2016/2017
@challengingtimes in my opinion it's best if you make a decision after consulting an expert. We are all in this forum because we have some sort of interest in the matter of citizenship, but we don't know all the details about your case or about citizenship laws. I don't know about Finland, but lawyers sometimes don't charge much if they are just giving you consultation, or there are sometimes volunteer lawyers who provide free service to immigrants or those who cannot afford high fees. good luck!

What happens if you are abroad (in an another EU country) but you keep your permanent address in Finland and do not change at Maistratti.tavastia wrote:When you change your address at Maistratti your residence period will be interrupted, you are not living in Finland for that period, is not a trip, so in my own opinion your last 2 years are interrupted.challengingtimes wrote: Less than 1 month need not be announced, I declared it in my application voluntarily. OK, this makes me WORRY now. During my past five years, I took a sabbatical leave from work (27-09-2014 to 22-03-2015, which is about 5 months and 23 days) and I was away from Finland during this period. Before moving out, I informed Maistratti that I will be away temporarily.
@tavastia, do you think this will disrupt my continuous residence? They did not give a big fuss about it when I applied for PR on my return, but now I am worried!

Re: Citizenship Application Autumn/Winter/Spring- 2016/2017
Perhaps, it is a good idea if you can indicate some contacts info of such lawyer/law firm so that others know where to turn in such situation.bigli wrote:@challengingtimes in my opinion it's best if you make a decision after consulting an expert. Hi all,
So far, my own time line has been:
Identity/documents verified 30/08/2016
Käsittelyssä 08/05/2017
No news since May 8. Judging by the posts here, it seems that the time from "käsittelyssä" to "päätös valmis" has a lot of variation - and I'm on the longer end of that variation!
I am doing my best to be very patient...

were there any confusions/questions in your applications? It looks that if the application is in order and all criteria are met without any question the decision is made right after the second stage.italosuomalainen wrote:Hi all,

Hi,
Is there anyone here apply for citizenship with your own business as a limited company?
