Hello!
I apologise if this is not a typical topic of discussion here, but it's a very stressful situation and we don't know where to ask.
My son is studying for his Master's degree in Finland (residence permit type A). However, due to complicated reasons I will not go into specifics here, he will likely be charged as a conscription evader in his home country (he has Belarusian citizenship), which is a criminal offence in both countries.
So, the question is, how likely it is that he will be deported? If not, how likely it is that he will not get extended or eventually permanent residence permit due to this criminal offence? Finnish Immigration Service said that they cannot say anything in advance. So, we would like to know, maybe there are some precedents? Just to understand what is the general thinking in such situations, and to what decision we should prepare.
We will be very grateful for any information, advice or place where we can ask about this!

Re: Deportation and residence permit precedence
These are several separate non-trivial questions, and the "complicated reasons" might also be relevant.SadPotato wrote: ↑Thu May 30, 2024 12:19 pmMy son is studying for his Master's degree in Finland (residence permit type A). Your son should ask a Finnish lawyer specialized in immigration law.
Re: Deportation and residence permit precedence
Nothing will happen on Finnish side. They don't care about his military duty in Belarus. Only serious crimes can lead to deportation.

Re: Deportation and residence permit precedence
Such an answer is not helpful since you do not understand the questions raised.
This part of the question is not about a deportation initiated by Finland, it is about whether Finland would honour a request to extradite based on an arrest warrant from another country.
Finnish men who do not serve in our armed forces or an alternative are sent to prison for half a year, and in Belarus they have 3 years in prison for their citizens.
There are many interesting legal topics in the original questions, and there are additional questions like what happens when the passport expires since Belarus will not renew it.
This really needs a lawyer who has an overview of all relevant legal topics.

I exactly understand the raised question and I have been in that situation. Belarus will not renew his passport if he doesn't solve the army problem (well many just bribe them to shut up). He will not be deported, nothing will happen. He is on A residence permit and soon will be eligible for Finnish citizenship. There is no need to dig up the matter with a lawyer, since I know how post soviet countries operate...FinlandGirl wrote: ↑Fri May 31, 2024 1:18 amSuch an answer is not helpful since you do not understand the questions raised.
