PR rejected

Post by LarryLion » Fri Aug 09, 2024 8:52 pm

I applied for PR recently under EU rules, but I had made a mistake with my dates, and they rejected it. People suggested you could apply one or two months early, but they've declined my application because the date I applied wasn't exactly right.

They also mentioned about a suspected incident that happened a few years ago, involving some road rage incident were I was followed by a guy who kept beeping his horn. This was not a charge, (its suspicion of criminal damage) the guy was being revengeful and said I damaged his car. They said because the case is still ongoing after all this time, if I am found guilty they might decide to deport me.

I found this all kind of ridiculous.

The way they worded it was something like, based on employment and family we don't see it as a block to temporary work, so we'll issue you a new residence card instead.

Now im really thinking whether I should even apply again.

I even tried to contact the police to find out what going on with my case, maybe to clear it all up, but I never hear back from them (tries phone and email) after all these years.

What should I do? Is migri indirectly telling me they're going to reject me for that?

You can use the process described here to access your data:

https://poliisi.fi/en/checking-personal-data

You can also make a subject access request to Migri to see what data they saved on you.

The suggestion wasn't wrong?

On migri's website:
However, you should not apply for a permanent residence permit before you are 3 months away from completing your four-year period of residence.

thanks for the suggestion. I did and all they sent me was a paper copy of all my previous applications, and one email from the person handling my case to the Police asking if they could use their 'data' in making a migri decision. Overall it didn't provide much insight

my case is a little different, the time period is calculated through cumulated use of a Blue Card. They said in my case you can't apply in advance, it has to be the exact date.

Then Migri hasn’t saved any data about the case and you need to ask the Police as the data controller.
