Is anyone in this forum who has applied in 2021? I applied in July 2021 queue number 6xx and am still on stage 1. I was told that my application could be processed in the Fall. I just want to know if anyone here applied in 2021 and what are your queue numbers.
You're likely the only one. I would honestly contact the
Ombudsman (Oikeausasiamies), and claim that you are being discriminated against. Explain that you have been waiting over 2 years, there's no lawful reason why you should be waiting so long and you have complied with all their requests etc. Explain that there is no good reason why it should take so long and make sure to stress that you paid them €450 (whatever it was at the time of the application) and so far they have just taken your money and given you nothing.
You should expect a reply from the Ombudsman within about 1 month. They will take your case seriously because it has been so long (if it was only 1 year of waiting, they likely would reject it). Whether or not they take your case seriously though will also depend on how good case you make to them.
Main things to mention would be:
1. That you have provided all documents clearly when requested and given all information and there is nothing on your side preventing them from making the decision.
2. That you have attempted to work things out with Migri and ask them to speed up the processing or at least give an explanation why they have been taking so long (this is mandatory, in that you MUST be able to prove you have at least spoken to Migri even ONCE about the status of your application before contacting the Ombudsman)
3. Claim that you are being discriminated against and that if you were some other nationality, they likely would have completed your application sooner. You can't prove this, but at the same time, based on the time you've been waiting, it's not a far cry to suggest.
4. Claim that Migri is failing their duty in giving you a resolution to your application in taking soo long and that their answers and excuses are not good enough or appropriate and do not serve you enough dignity. Mention that their service should not incur such a long wait and that it is a disgrace and the processing fee is too expensive for such bad and uncaring service.
5. Lastly, make sure to mention that so far you have paid €450 and got nothing. They have simply taken your money and given you nothing for it. That you legally are required to have the decision and all you want is them to process the application. That is it.
If you can mention those things, provide them evidence that you have asked them for information or to speed things up but they have rejected you. They will take the case seriously. They are legally obligated to take you seriously, especially if you claim the things I mentioned and can prove you've spoken to Migri (and got nothing fair from them) and also that you have been waiting over 2 years.
I would expect that as soon as they get to your case in Oikeausasiamies, it would take less than 2 weeks for them to put their foot up Migri's ass and make them process it immediately.
Bear in mind, you're likely at such a low number because you were either:
1. Missing original documents you needed when you made your application
2. Had not lived here long enough at the time you applied
3. Are from a country on the list
4. Have documents that are hard to verify if they are genuine
5. Have had some other difficulties or legal issues or something else
No one ends up waiting 2+ years unless there's multiple factors involved. In any case, follow the instructions I provided and keep us informed. You have nothing to lose and Oikeausasiamies is a free service that our tax dollars pay for. Also every time Oikeausasiamies has to step in and solve something, it puts legal pressure on the govt service (in this case Migri) to clean up their sh!t. I did the same with Traficom and have had great success. As soon as you point to OAM most organizations get their stuff together immediately otherwise they risk a fine and being sued.
If you don't bother to complain to Oikeausasiamies and get them to investigate then you have no right to complain about the processing time. These people literally exist to hold government services accountable. It's what our tax dollars are working for...
I will complain myself if my application ever reaches 24 months (which is in less than 5 months time). But I will give them at least until the end of the year.
