residence permit help please
residence permit help please
Hi. I have read all the posts on here, and hope that someone can lead me in the right direction. I applied for a residence permit on basis of family, ( my partner accepted a temporary position here) I went to the Finnish embassy in May, and since I am an american citizen, they told me I could come here for 90 days , but would have to return to get my stamp. Basically, they said i could expect an answer within 8 weeks. Now, I have continued to enquire on the status, was told it was ready just waiting for it to be sent, then we get a letter here in finland, from uvi asking for more information, which we sent back. It is now coming down to days and hours until my visiting priviledges are finished. I called and spoke to person in charge at directorates office, and they informed me that there are so many ahead of me that it could take much more time. I asked three different people there, while trying to get this information, if I could stay past the 90 days, because my partner is my only source of income, and as such have no other place to go. One told me, yes I can stay, but if the permit is denied, I will have trouble when I leave, second one told me if I had applied in Finland then I could stay, but since I did not, I have to leave, (which by the way, when I first enquired about this exact thing, whether to apply first or come here and apply, I was told by the embassy that I could not apply in finland)and finally the third told me to go to my embassy and ask for an extension, but when I called they said they could not help me and directed me back to the directorates office. I even called the embassy to which I applied and they told me it is done but just sitting on someones desk.
If anyone at all can give me a lead as to where I can find out exactly what I can do, I would appreciate it. I do not want this to be a permanent stay, and at most would be here for 6 more months only. I just do not wish to get into a situation where I will have trouble for staying.
thank you sooo much for any advice...

Three questions.
What nationality is your partner?
How long have you been living together in total..not just in Finland?
How long is your partner planing to stay here, and if NON EU, on what type of permit?

People do not become more irritable as they grow old - they simply stop making the effort to avoid annoying others.
This is a key factor...starlite wrote: We have been living together approx 2 years.
As far as Finnish immigration is concerned .."living together for at least 2 years" is the stipulation that = married status.
Assume he has a work permit and it is almost two years that you have been together.
Take the line that you have a "common law marriage" and take the case to the local police stations immigration officer in person (together).and ask for an extension to your current visa.

I went to the police station today, they can not do anything at all, because they say it is a case abroad. (I applied in UK) I also asked if I may stay until the decision comes but again received two different answers. Where may I look or whome can I speak to, that would give me the correct information? I am just very worried that my time is slipping by, and I do not want to be here illegally, any help at all please. thank you in advance

Hi Starlite et al,
See clause 2 of section 40 of the Alien's Act (301/2004), wherein it [the unoffical English version] states thus:An alien may reside legally in the country while his or her application is being processed until there is a final decision on the matter or an enforceable decision on his or her removal from the country.
On a related note, see also section 49.
Furthermore, see also Section 30 – Competence to issue visas or extend the number of days of residence, wherein it states thus: A re-entry visa and an extension to the number of days of residence under a Schengen visa are issued by the District Police.
NOTE: This is not a definitive advice, just my mere opinion. Contact Daryl for reliable advice.
Cheers.
