I have been married to a finnish man since October 2005. I got my first A permit in January 2006. Due to international differences, the marriage is now on the rocks and my husband has already filled a divorse at the court. The court has given us 6 months for either reconciliation or to end the marriage. The 6 months periods ends in February 2007. My first A permit also expire in January 2007.
I have been working for the past 4 months now and my contract is open ended - no specified date. I am suppose to renew my next permit any moment from now.
Please since my partner wants a divorse, he will not sign on my permit renewal form.
Do you think I will still get the A permit even if he does not sign the forms since the marriage is not yet over at the court?
Do you think, my permit will be renew based on my open ended contract?
Do you think, I will get a three year permit when renewing this? Please advice.
Thanks Esther
My divorse and Permit.

Hi Esther,
Daryl is the expert on immigration issues and would be the best person to give you specific and accurate advice on this issue. Contact him directly.
Meanwhile, here is an an opinion (and Daryl must correct me if I am wrong):
Permit are renewed on the grounds presented, i.e. if there are grounds to renew the permit. You mentioned that you have an open ended job, which in other words, is grounds of a continuous nature. This could be your grounds for requesting/renewing a worker's residence permit. Thus, you could request an A permit based on the continuous nature of your job. If approved, you might get an A permit.
To do this, I believe your employer has to fill out a certain form (TM 054) which you would have to submit along with the application. The link from where you can download the form is at the bottom of this post.
Furthermore, if you are requesting a workers residence permit, IMVHO, the spouse's signature is not required since there is no relation between the grounds presented while requesting a permit and the spouse / marriage.
However, What I am not sure about is the renewing of a continuous permit type when the grounds for issuing such a permit has changed from a previously declared one. Only Daryl can clarify this.
Kind regards.

Divorce proceedings
Esther, if it is a normal divorce application you should have a period of at least six months before the final application can be filed and the marriage officially ended.
You did not mention if you are a EU citizen or not.
Very short marriages can lead to raised eyebrows when the authorities consider residence permits, but work and income should favour an applicant.
