Hi everybody,
Does anybody know how to appeal against a refusal to the extension of the student residence permit in Helsinki.
After studying one year, I had applied for the extension, but refused. I have 30 days to apply for an appeal.
Who can help me with this? any lawyer you could recommend?
Does anyone ever had the same case as mine of refusal?

Well, why were you refused? I mean what do they refuse for... not enough study credits? not enough income to show? lacking health insurance?
Usually getting rid of the cause of refusal is a good idea.

Hank W., yes the reason given is, not enough credit hours!
I am studying part time for the Master's degree program, & a letter from the institution was provided saying that the quantity of my credit hours is 30.
the questions are:
"Has ever anyone appealed against a negative decision?" if yes,
"How its done?" & "how long it may take?"
"are there any chances of getting a positive result through appealing?"

raamv, sorry, I meant does anyone had ever appealed against refusal?
mine is not enough credit hours, although I have 30 credit hours for my part time studies!

This is how they define the specs on the migri.fi pages...
"An extension of the permit requires that the student is still registered at the educational institution,
is a full-time student and has completed the required courses in the institution's study programme."
Could this "part-time student" status of yours actually be the issue here? If yes - then I wonder, on what grounds were you initially given the
first residence permit... if they knew your studies were going to be part-time only... hmm. Could you build on that, I mean if you wish to appeal? Just a few thoughts - I haven't heard of a "part-time student" case like this before.

sammy, thanks for the reference from migri.fi, it might be so.
Although, they knew when giving me the 1st residence permit, that it will be part time, as I mentioned my work place & work contact details in the form!

Well are they supposed to be some kind of mind readers? The job is irrelevant unless you are applying for a workers residence permit.
Now a student on a student residence permit is allowed to work part-time maximum 25 hours during his full-time studies, but that doesn't mean the primary reason for being in the country is work. Kind of hard to see what you would be appealing against. as apparently you are not here to study, where did they make the mistake exactly?
Don't know if you'd have luck in getting a workers residence permit, but looks like you screwed up the student path... unless you have some "floating" credits you can catch.

guys please don't kick me hard!
the point is that I am not working in Finland! I come to Finland for the sole reason of studying!!!
I am enrolled for the course as an attendant student, but classes are held once or twice a month for 3-4 days.
not yet completely screwed up with the student path...

have some what you called "floating" credits, that I can catch!

OK, so then you need to get your "studying" into a form you can explain to them, you have 30 days to appeal (says in there as to how and where) and if might be also useful to get someone from the school to write of what the courses are... like if you get all in the end of a longer period. Don't know though how many credits they require.

if you are now working full time try to change your resident permit to worker
because i think they wont renew your student one ( lack of credits )
+ you came here to study not to work ( in other words you dont need to work because you had to show that you are financially independent )
( the other choice try to find a Finn to marry ( joke )

i smell a rat here...........
if you are doing parttime masters.... trust me credit hours in a year can't be more than 42 and you claim to have 30 credit hours already!!! I seriously doubt if you have had even 18 credits... pal!!!
or giving you a benefit of doubt...... perhaps.... ministry of finnish education might have screwed up home ministry of finland a bit

(if the rule that dictates only full-time students are allowed resident permit holds good)
