Will I lost my Residence permit after I divorce?

Post by Kyykaarme » Wed Apr 30, 2014 10:47 am

I have done the final application for the divorcement. It's going to take effect in next week. I'm an Asian and my ex is Finnish, our marriage is almost 2years. Now my residence permit is Type A availed until 2017. I wanna know whether I will lost it right now or I could stay here legally until my current visa expire? I'm now a student but going to graduation in end of May. I'm now applying for another school but I don't know about the result yet. In the summer I'm going to visit my country for 2 months, I'm just afraid that whether it would happen my residence permit be revoked during I'm not in Finland?
Thanks a lot, please give me some help.

You have to report any chances in your status that can influence the residence permit. It might be revoked or you might stay its validity. It depends how they judge your situation.
our marriage is almost 2years
Iirc that is the minimum time for a divorce.
So marry, get a RP and then divorce at the first opportunity. It doesn't sound convincing.
I'm now applying for another school but I don't know about the result yet.
You might get a new RP based on study (if you fulfill the requirements; money, health insurance)

I cannot guess what the result may be, but I'm not sure you can stay till 2017.

I met my ex in Japan, but he changed totally different after we moved back to his own country. Alcohol ,game for everyday. I gave up my master degree in Japan for living together with him, but even his mother think that I should divorce cause I'm still so young and even she can't see any hope for me to be with him. Marriage was completely true and convinced. I haven't receive the decision from count now, what shall I do? Go police to tell them or I just stay seek for job with my currently RP?

I do not find that kind of requirement in the law(?)

Revoking the existing permit is possible. I've got the impression from this board it would be rare in practice. The poster though seems to have a four year permit that is less than year old.

Even if the current permit would not be revoked, it will eventually expire and there should be a valid reason for a new one.

I don't see a direct connection, but I'd see to it that somebody checks your mail during that time.

Thanks a lot Rip, I think I could figure it out before my currently RP expire. I am applying for university while seeking for full-time job, only the problem is concern with time. I have heard from another friend who have similar situation with me, he also have 4 years A Rp when he divorced, but after 4 years he changed his national into Finnish instead of permanent residence permit. I'm just afraid police cancel my visa when I'm not in Finland without notice or explain. I have somebody in relation at this moment, it's also a Finnish ,but last marriage hurt me a lot so I don't dare to step in marriage any more...well at least not now. Will it be helpful that I tell police about this if they call me to explain?

Thanks again.

But you should have 5 years of residence, if you're divorced and no other particular ties to this country.

I don't think they will even find out (you'd be just making a trip, without notification to the "maistraatti".) But you should try think somebody that you can trust that could look after your mail in case you'd get an unwelcome letter.

I'm not sure, but perhaps you should stick to more concrete things on one hand and then refer to friends etc here in more general terms - but if it comes to that then you'd better have some proper reason for new permit. Steady work would be best.

If you're citizen of Japan (or some other comparable country) you have the right to enter and/or stay here also without a residence permit for up to 90 days - and that time period starts from zero were your residence permit to end, so even in the worst case you'd have about three months to enact "Plan B" and apply for a new residence permit. Graduating from local school means that an employment based permit would not be subject to consideration of the local employment office.
