Prenup / prenuptial agreements: do they always work here?

Post by dsi11 » Sat Jan 16, 2016 12:14 pm

Does an adequately written prenuptial agreement always hold in Finland?

Sounds like many in the USA get married thinking they have a solid prenup and then it backfires on them when divorce happens.
Has anybody heard similar things happening in Finland?

I like younger Asian girls, so might need to protect myself, haha

If that's your fetish, then keep exercising it and separate it from long-term plans such as marriage, especially if you have strong suspicions that bride-to-be is a gold-diggers. Having that said, people asking on random online forums don't usually have a lot of gold to be dug.

Another thing to keep in mind is that young Asian girls (whatever that means), don't stay young forever, which applies to all young things/people. So, at some point, one way or the other, you're gonna wanna find another "younger Asian girl", and the institution of marriage perhaps isn't the most suitable for such lifestyle.

Pick one who's already in the country and doesn't need you for an RP.

True, but Asian girls age well, so I am also attracted to Asian women in their 30s, 40s, 50s, etc. But if I have the looks and charm to get a girl in her 20s now (I am 42), then why not take advantage of that?

The reason why I consider marriage (an institution that I think is silly anyways), is because Finnish embassies in Philippines, Vietnam, Thailand, etc rarely give RPs or even tourist visa's unless you're married. If I find a girl I really enjoy being with, then I could consider marriage, hence the question about prenups.

It would be easier if I was hooking up with an African or Muslim man (they seem to get here easily) but that's not my fetish

True, but the girls who are already here often are divorced with children (that's how they got here). I don't like or want kids.

So, can anybody comment on the original question about prenups instead of being judgmental on my choice of women?

Thanks :)

I have found that page earlier too, and it gives valuable info, but the question is about prenups... which I understand can be applicable in Finland, no?

And specifically, are they always held up in court.

You are not alone. It amuses me to see Finnish males getting visibly elated getting to talk to petite South-Eastern Asian girls :D

Not always:

Section 103b (411/1987)
(1) The distribution of matrimonial property may be adjusted if the distribution would
otherwise lead to an unreasonable result or to the other spouse receiving unjust financial benefit. When considering whether to adjust the distribution, special attention shall be paid to the duration of the marriage, the activities of the spouses for their common household and for the accumulation and preservation of the property, as well as to other comparable facts regarding the finances of the spouses.

Have you thought the third step (step 1 marriage, step 2 divorce), you have children or she is pregnant? Prenuptial will not cover that, if you are married you will be the father and can not escape the consequences.

Even without prenup
A) Alimony, in the sense of paying support to your former spouse (spouse, not children) although possible, is quite rare (any existing property will be split without prenup though)
B) Child support payments, if you're rich, are lot less than in some other countries. Basically if you're a millionaire, offering a millionaires material living standard to your children living with your ex is optional, not something that would be enforced by courts.

Why digging your while you are still alive? Is your wealth more worthy than love? You are already a loser in marriage even before attempting to go into it. Always wish yourself for better or for worse you can still remain friends and even with divorce your autobiography / biography still will tell she once made you laugh and made you feel excited on bedtime!

Prenuptial agreements on how property will be divided in divorce are generally valid in Finland. They need to follow a standard form and be registered. International cases are tricky, though. If even one of you lives abroad, they may apply for divorce in that country, and the local court may ignore the agreement. There is a lot of "forum shopping" going on in divorce cases. Beware also that if the contract includes any non-standard clauses not drafted by a competent lawyer, Finnish courts may find the entire document invalid. Similar problems could arise if you sign the pre-nup abroad and it does not follow the Finnish standard form.

Personally, I would suggest finding an equal partner with whom you are willing the share everything.
